1. Acceptance of Terms

By accessing or using Sens8Focus (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to all of these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and Sens8Focus.

We encourage you to read these Terms carefully. Your continued use of the Service after any changes to these Terms constitutes your acceptance of the revised Terms.

2. Description of Service

Sens8Focus is a self-guided digital tool for tracking sensate focus therapy exercises. It is not a medical service, therapy service, or substitute for professional care.

The Service provides exercise tracking, journaling, progress visualization, and optional partner-sharing features designed to support your personal or couples therapy journey. All content and guidance within the Service is educational in nature and should not replace the advice of a licensed healthcare provider, therapist, or counselor.

If you are working with a clinician, Sens8Focus is designed to complement — not replace — that therapeutic relationship.

3. Age Requirement

You must be at least 18 years of age to create an account or use Sens8Focus. By using the Service, you represent and warrant that you are at least 18 years old. We do not knowingly collect or solicit information from anyone under the age of 18.

4. Account Responsibilities

When you create an account with Sens8Focus, you are responsible for:

• Maintaining the confidentiality of your login credentials and any activities that occur under your account.
• Providing accurate, current, and complete information during registration and keeping your account information up to date.
• Notifying us immediately at support@sens8focus.com if you suspect any unauthorized use of your account.

You acknowledge that Sens8Focus is not responsible for any loss or damage arising from your failure to safeguard your account credentials.

5. Subscription and Billing

Sens8Focus offers both free and paid subscription tiers. By subscribing to a paid plan, you agree to pay the applicable fees as described at the time of purchase.

• Recurring billing: Paid subscriptions automatically renew at the end of each billing cycle unless cancelled before the renewal date.
• Cancellation: You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period; you retain access until then.
• Refunds: We do not provide refunds for partial billing periods. If you believe a charge was made in error, please contact us within 30 days.
• Price changes: We may adjust pricing with at least 30 days' notice. Continued use after a price change constitutes acceptance of the new pricing.

6. Privacy and Health Data

We take the privacy of your health-related data very seriously. Your use of the Service is also governed by our Privacy Policy and HIPAA Notice.

All personal health information is encrypted at rest and in transit. Journal entries are protected with field-level encryption. We maintain HIPAA-compliant infrastructure and enter into Business Associate Agreements (BAAs) with all third-party service providers who may access protected health information.

7. Prohibited Uses

You agree not to use the Service to:

• Violate any applicable local, state, national, or international law.
• Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity.
• Attempt to gain unauthorized access to other users' accounts, data, or any part of the Service's infrastructure.
• Interfere with or disrupt the Service, servers, or networks connected to the Service.
• Use the Service for any purpose that is harmful, abusive, harassing, or otherwise objectionable.
• Scrape, crawl, or use automated means to access the Service without our prior written consent.

8. Intellectual Property

The Service and its original content (excluding user-generated content), features, and functionality are owned by Sens8Focus and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of any content you create within the Service, including journal entries and notes. By using the Service, you grant us a limited license to store, process, and display your content solely for the purpose of providing the Service to you.

9. Disclaimer of Warranties

To the fullest extent permitted by law, Sens8Focus disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free.

The information and content provided through the Service are for informational and educational purposes only. Always seek the advice of a qualified healthcare provider with any questions regarding a medical condition or treatment.

10. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Sens8Focus, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to, use of, or inability to use the Service.
• Any conduct or content of any third party on the Service.
• Any content obtained from the Service.
• Unauthorized access, use, or alteration of your transmissions or content.

Our total liability for all claims related to the Service shall not exceed the amount you have paid us in the twelve (12) months preceding the claim.

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms.

Upon termination, your right to use the Service will immediately cease. You may request a copy of your data before or within 30 days after termination by contacting us. After 30 days, we may permanently delete your data in accordance with our data retention policies.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect, via email or a prominent notice within the Service.

Your continued use of the Service after any changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, you are free to stop using the Service.
