HIPAA Notice of Privacy Practices

This notice describes how health information about you may be used and disclosed and how you can get access to this information. Please review it carefully.
1. Our Commitment
Sens8Focus is committed to protecting the privacy of your Protected Health Information (PHI). We understand that the information you share through our platform is sensitive and personal, and we treat it with the highest level of care.
We are required by law to maintain the privacy and security of your PHI, provide you with this notice of our legal duties and privacy practices, and abide by the terms of this notice as currently in effect. We will notify you promptly if a breach occurs that may have compromised the privacy or security of your information.
2. How We May Use and Disclose Your PHI
We may use and disclose your Protected Health Information in the following circumstances:
To Provide the Service
We use your PHI to deliver the core features of Sens8Focus, including tracking your sensate focus exercises, generating progress visualizations, and facilitating partner-sharing when you opt in.
For Health Care Operations
We may use your PHI for operational purposes such as quality assessment, improving the Service, conducting audits, and training authorized personnel. When used for such purposes, data is aggregated and de-identified whenever possible.
With Your Written Authorization
We will obtain your written authorization before using or disclosing your PHI for any purpose not described in this notice. You may revoke your authorization at any time in writing, though revocation will not affect any actions we have already taken in reliance on your prior authorization.
As Required by Law
We may disclose your PHI when required by federal, state, or local law, including for public health activities, health oversight, judicial or administrative proceedings, law enforcement purposes (subject to specific conditions), and to avert a serious threat to health or safety.
3. Your Rights Regarding Your PHI
Under HIPAA, you have the following rights regarding your Protected Health Information:
Right to Access
You have the right to inspect and obtain a copy of your PHI that we maintain. We will provide your information in a readily producible electronic format. You can request your data at any time through your account settings or by contacting us directly.
Right to Amend
You have the right to request that we amend your PHI if you believe it is inaccurate or incomplete. We will respond to your request within 60 days. If we deny your request, we will provide a written explanation and inform you of your right to submit a statement of disagreement.
Right to an Accounting of Disclosures
You have the right to request a list of certain disclosures we have made of your PHI. This accounting will include disclosures made in the six years prior to your request (or a shorter period if you specify). The first request within a 12-month period is provided free of charge.
Right to Request Restrictions
You have the right to request that we limit how we use or disclose your PHI. While we are not required to agree to all restriction requests, we will carefully consider each one. If we do agree to a restriction, we will comply with it except in emergency situations.
Right to Confidential Communications
You have the right to request that we communicate with you about your PHI in a specific way or at a specific location. For example, you may request that we only contact you at a particular email address. We will accommodate reasonable requests.
Right to a Paper Copy
You have the right to obtain a paper copy of this Notice of Privacy Practices at any time, even if you have previously agreed to receive it electronically. You may request a paper copy by contacting us.
4. Our Duties
Sens8Focus is required to:
- Maintain the privacy and security of your Protected Health Information.
- Provide you with this Notice of our legal duties and privacy practices with respect to your PHI.
- Abide by the terms of this Notice as currently in effect.
- Notify you if we are unable to agree to a requested restriction on how we use or disclose your PHI.
- Notify you within 60 days if a breach of your unsecured PHI occurs.
- Accommodate reasonable requests to communicate with you by alternative means or at alternative locations.
5. Changes to This Notice
We reserve the right to change this Notice of Privacy Practices and to make the revised notice effective for all PHI we already maintain as well as any PHI we receive in the future. When we make a material change, we will:
- Post the revised notice on our website and within the Service.
- Update the “Last Updated” date at the top of this notice.
- Notify you by email at least 30 days before the changes take effect.
6. Complaints
If you believe your privacy rights have been violated, you have the right to file a complaint:
- With Sens8Focus: Contact our Privacy Officer at privacy@sens8focus.com. We will investigate and respond to your complaint promptly.
- With the U.S. Department of Health and Human Services: You may file a complaint with the Secretary of HHS. We will provide you with the address upon request.
We will not retaliate against you for filing a complaint.
7. Effective Date
This Notice of Privacy Practices is effective as of March 28, 2026. It applies to all Protected Health Information maintained by Sens8Focus as of this date and all PHI created or received after this date.
